An individual may be a resident although not domiciled in the State of California, and, conversely, may be domiciled in the state without being a resident.

The CCPA grants new rights to California consumers

1. The right to know what personal information is collected, used, shared, or sold, both as to the categories and specific pieces of personal information

2. The
right to delete personal information held by businesses and by extension, a business's service provider(s)

3. The
right to opt out of sale of personal information. Consumers are able to direct a business that sells personal information to stop selling that information. Children under the age of 16 must provide opt-in consent, with a parent or legal guardian consenting for children under age 13.

4. The
right to non-discrimination in terms of price or service when a consumer exercises a privacy right under CCPA.

The CCPA imposes new business obligations

1. Businesses subject to the CCPA [which have $25 million+ gross annual revenues, buys, receives or sells personal information of 50,000 or more consumers, households, or devices; or derives 50% or more of annual revenues from selling consumers' personal information] must provide notice to consumers at or before data collection. Also, per the proposed drafted regulations, businesses that handle the personal information of more than 4 million consumers will have additional obligations.

2. Businesses must
create procedures to respond to requests from consumers to opt out, know, and delete. For requests to opt out, businesses must provide a "Do Not Sell My Info" link on their website or mobile app.

3. Businesses must respond to requests from consumers to know, delete, and opt out within specific timeframes. Draft regulations state businesses must treat user-enabled privacy settings that signal a consumer's choice to opt out as a validly submitted opt-out request.

  • 4. Businesses must verify the identity of consumers who make requests to know and to delete, whether or not the consumer maintains a password-protected account with the business.
  • California consumers have the right to request that Advantage Mortgage Service disclose what personal information it collects, uses, discloses, and sells about them.
  • This information will only be disclosed to a California consumer upon receipt of a verifiable consumer request as outlined in the information below.

California Consumer Information that Advantage Mortgage Service May Collect and Store from Your Access and Use of the Platform

  • Identifiers and categories of personal information described in California Civil Code Section 1798.80(e): First and Last Name, Mailing Address, E-Mail Address, Telephone or Mobile Number, IP Address.

  • Characteristics of protected classifications under California or federal law: Date of birth or Age, Gender.

  • Commercial Information: Purchase and Usage History, Credit Card or Debit Card Account Number, PayPal Account information, Apple Pay Information

  • Internet or other electronic network information: Social Media Information, including Facebook, Instagram or Twitter ID, Browser, Device, Operating System and Hardware Type.

  • Geolocation data: IP-based geolocation data.

  • Inferences drawn from any of the above.


Disclosure or Sale of Personal Information

Advantage Mortgage Service
does not and will not sell your personal information. (Please note that the CCPA uses an expanded definition of the term “sell,” in which “sell” means: “Selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s personal information by the business to a third party for valuable consideration; or (B) sharing orally, in writing, or by electronic or other means, a consumer’s personal information with a third party, whether for valuable consideration or for no consideration, for the third party’s commercial purposes.”)

Right to Non-Discrimination for the Exercise of a California Consumer's Privacy


California consumers have the right not to receive discriminatory treatment for the exercise of their privacy rights conferred by the California Consumer Privacy Act.

This includes, but is not limited to:

(A) Denying goods or services to a California consumer.
(B) Charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties.
(C) Providing a different level or quality of goods or services to a California consumer.
(D) Suggesting that a California consumer will receive a different price or rate for goods or services or a different level or quality of goods or services.

For California consumers, an authorized agent is a natural person or a business entity registered with the California Secretary of State that a California consumer has authorized to act on their behalf subject to the requirements outlined below and in California law. Requirements for a California consumer’s agent to submit a request to know or a request to delete

When a California consumer uses an authorized agent to submit a request to know or a request to delete, Advantage Mortgage Service may require that the consumer:

(1)  Provide the authorized agent written permission to do so; and
(2)  Verify their own identity directly with the business.

These steps do not apply if a California consumer has provided the authorized agent with power of attorney pursuant to pertinent sections California Probate Code.

Advantage Mortgage Service may deny a request to know or a request to delete from an agent who does not submit proof that they have been authorized by the California consumer to act on their behalf.

Advantage Mortgage Service does not knowingly sell personal information of California consumers under the age of 16 without permission from a parent or guardian. If you think we have, please let us know.

Data Protection Directive (officially Directive 95/46/EC on the protection of individuals with regard to processing of personal data ( (PII US) ) and on the free movement of such data) was a European Union directive adopted in 1995 which regulates the processing of personal data within the European Union. It is an important component of EU privacy and human rights law.

The General Data Protection Regulation adopted in April, 2016 has superseded the Data Protection Directive and became enforceable starting May 25, 2018. The seven principles governing the OECD's recommendations for protection of personal data were:

1. Notice—data subjects should be given notice when their data is being collected;
2. Purpose—data should only be used for the purpose stated and not for any other purposes;
3. Consent—data should not be disclosed without the data subject's consent;
4. Security—collected data should be kept secure from any potential abuses;
5. Disclosure—data subjects should be informed as to who is collecting their data;
6. Access—data subjects should be allowed to access their data and make corrections to any inaccurate data;
7. Accountability—data subjects should have a method available to them to hold data collectors accountable for not following the above
principles.

The OECD guidelines, however, were non-binding, and data privacy laws still varied widely across Europe.

The EC has set a compliance date of 25 May 2018, giving businesses around the world a chance to prepare for compliance, review data protection language in contracts, consider transition to international standards, update privacy policies, and review marketing plans.

Under GDPR, companies must develop
processes and/or systems to respond to individual requests for access to personal information and for erasure of personal information.
